Terms of Service
Welcome to mbuzi.ke (the “Platform”), operated by Mbuzi Treats (“Mbuzi Treats”, “we”, “our”, “us”). These Terms of Service (“Terms”) form a binding contract between Mbuzi Treats and every customer or visitor (“you”, “your”). By ordering meat or butchery services from us—whether online, by phone, in person, or via WhatsApp—you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy.
1. Eligibility & Acceptance
1.1 You must be at least 18 years old (or acting under a guardian’s supervision) and legally capable of entering contracts.
1.2 If you represent a company, you warrant that you are authorised to bind that entity.
2. Products & Services
2.1 We supply halal-certified, grass-fed goat and sheep as well as selected beef, lamb and poultry cuts (collectively, the “Products”).
2.2 Optional butchery services include portioning, mincing, marinating, vacuum-packing and other meat-preparation services (the “Services”).
2.3 Photographs are for illustration only; carcass size, colour and fat cover may vary naturally.
3. Pricing & Payment
3.1 All prices are shown in Kenyan Shillings (KSh) and include VAT where applicable.
3.2 Prices may change without prior notice, but the price confirmed at checkout (or in your WhatsApp invoice) is the price payable.
3.3 Full payment is due when you place an order. Accepted methods:
• Cash (shop collections)
• Major credit/debit cards
• Mobile money (M-Pesa PayBill / Till)
3.4 If payment fails or is reversed, we may cancel or suspend fulfilment.
4. Orders, Collection & Delivery
4.1 You may order in store, by phone/WhatsApp, or via the Platform.
4.2 Delivery zones, time slots and fees are displayed at checkout or communicated during phone orders.
4.3 Risk of loss and title pass to you when Products are delivered to the address or handed to your authorised representative.
4.4 If no one is available to receive a perishable order at the agreed time, we may return the Products to cold storage and charge a re-delivery fee.
5. Returns, Refunds & Complaints
5.1 Because meat is perishable, returns are accepted only for quality or fulfilment issues reported within 24 hours of delivery/collection.
5.2 Provide clear photo evidence and keep the Product refrigerated while we investigate.
5.3 At our discretion we will (a) replace the Product, (b) issue store credit, or (c) refund the purchase price. Delivery fees are non-refundable unless the issue was our fault.
6. Hygiene & Quality Assurance
6.1 All processing occurs in licensed, hygienic facilities under trained staff who follow HACCP and Kenya Bureau of Standards guidelines.
6.2 Cold-chain integrity is maintained from slaughterhouse to delivery.
7. Your Responsibilities
7.1 Inspect Products on delivery and notify us immediately of any problem.
7.2 Refrigerate or freeze meat promptly and cook to safe internal temperatures.
7.3 Follow any additional storage or preparation instructions we provide. We are not liable for spoilage or illness arising from improper handling after delivery.
8. Warranties & Disclaimers
8.1 We warrant that Products are fit for human consumption when delivered.
8.2 Except for this express warranty, the Platform, Products and Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all other warranties (statutory, implied or otherwise), including fitness for a particular purpose.
9. Limitation of Liability
9.1 To the fullest extent allowed by Kenyan law, Mbuzi Treats is not liable for indirect, incidental or consequential damages, or for any amount exceeding the total you paid for the order giving rise to the claim.
9.2 Nothing in these Terms limits liability for death or personal injury caused by negligence, or any liability that cannot be excluded by law.
10. Indemnity
You agree to indemnify and hold harmless Mbuzi Treats, its directors, employees and affiliates from any claim or demand arising out of (a) your misuse of the Products, or (b) your breach of these Terms.
11. Privacy
Your Personal Data is processed in accordance with our Privacy Policy. By placing an order you consent to that processing.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Any dispute shall first be resolved amicably; failing that, the courts of Nairobi have exclusive jurisdiction.
13. Changes to Terms
We may update these Terms from time to time. Revised Terms take effect on the “Last updated” date shown above. Continued use of the Platform or Services after that date constitutes acceptance.
